Abstract

Abstract

This commentary discusses the way in which climate treaties were interpreted by the International Court of Justice in its advisory opinion of 23 July 2025 on the obligations of states in respect of climate change. More specifically, it analyzes how the court exercised its interpretative function when confronted with particularly ambiguous provisions of the Paris Agreement and highlights the questions raised in this regard by certain passages of the advisory opinion. This commentary suggests that, in the course of its interpretation, the court at times appears to have simplified — perhaps even without fully realizing it — the meaning that the drafters of the Paris Agreement had intended to give to certain provisions of that treaty.
